Revisions to Tawan's Civil Code
The Ministry of Justice's Department of Legal Affairs is in the process of revising Taiwan's Civil Code. The Department has published a series of draft amendments (in Chinese) on the Ministry's web site as well as comments received at public hearings. The amendments to the Code that may be divided into three broad categories: amendments to Book I General Principles, Chapter III Superficies of Book III Rights Over Things, and Book IV Family.
The corresponding Enforcement Regulations to Book I General Principles and Book IV Family are also being updated. Once the Ministry completes the statutory hearing process, it will submit the draft amendments to the Executive Yuan for approval. After approval, the draft amendments will be sent to the Legislative Yuan where further revision is likely.
